Terms of Service

1. Acceptance of Terms

By downloading, installing, or using LotusPing ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Software on a single computer
  • Use the Software for your personal or business network monitoring purposes
  • Receive updates and support during the license period

3. Trial Period

LotusPing is provided with a 14-day free trial period. During the trial period:

  • You have full access to all features
  • No credit card or payment information is required
  • The trial automatically expires after 14 days
  • You may purchase a license at any time during or after the trial

4. License Purchase and Activation

To continue using LotusPing after the trial period, you must:

  • Purchase a license key through our authorized payment processor (Paddle)
  • Activate the license key within the Software
  • Each license key is valid for a single computer
  • License keys are non-transferable without written permission

5. Restrictions

You may NOT:

  • Copy, modify, distribute, sell, or lease the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the Software for any illegal or unauthorized purpose
  • Share your license key with others
  • Install the Software on multiple computers with a single license (unless you purchase additional licenses)
  • Use the Software to violate any laws or regulations

6. Intellectual Property

The Software, including all code, graphics, logos, and documentation, is the property of LotusPing and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

7. User Data and Privacy

LotusPing is designed to operate locally on your computer:

  • All device data, floor plans, and settings are stored locally on your computer
  • We do not collect, transmit, or store your network data
  • License validation may require internet connectivity

8. Updates and Support

With a valid license, you are entitled to:

  • Free updates to the Software (bug fixes, new features, etc.)
  • Email support for technical issues
  • Access to documentation and help resources

We reserve the right to discontinue support for older versions of the Software.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Software will be error-free, uninterrupted, or meet your specific requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOTUSPING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.

Our total liability shall not exceed the amount you paid for the license.

11. Termination

Your license is effective until terminated. We may terminate your license immediately if you violate these Terms. Upon termination:

  • Your right to use the Software ceases
  • You must uninstall the Software
  • All provisions that by their nature should survive termination shall survive

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Software. Continued use of the Software after changes constitutes acceptance of the new Terms.
